Terms and Conditions

These General Terms and Conditions apply to reservations and agreements with regard to the holiday home Villa Meddo, Hilgeloweg 2 14, 7041BG Winterswijk Meddo

In these General Terms and Conditions, the term 'tenant' is understood to mean: the person who enters into an agreement with us regarding the rental of the holiday home.

These General Terms and Conditions apply regardless of your (prior) reference to any own terms and conditions or to other general terms and conditions. We disclaim any Terms and Conditions to which you refer or which are used by you.

Agreements deviating from these General Terms and Conditions are only valid if agreed in writing.

Reservation

We only accept reservations from persons who are 22 years or older. Reservations by persons younger than that age are therefore not valid.

After you have made a reservation, you will receive an invoice from us within 5 days. We ask you to check these documents for accuracy and to notify us immediately of any inaccuracies. If you have not received a confirmation of receipt from us within 10 days after making the reservation, please contact us.

Down payment and payment

After receipt of the deposit, your reservation is final. We request that you transfer 40% of the rent to us within 14 days after the invoice date. The other 60% must be paid to us no later than 1 month before the arrival date. If your reservation is within 1 month before the arrival date, you must transfer 100% of the invoice amount to us at once upon receipt of the invoice.

You transfer the deposit and/or payment to IBAN: NL86 INGB 000 6180 864 in the name of MGDoedens, stating the invoice number.

By paying an installment of or the entire rental amount, you confirm that you have read and agree to the general terms and conditions. The rental ends automatically after the agreed period has expired.

In the event of late payment of the amounts invoiced to you, you will be in default immediately after the payment term has expired. In that case we reserve the right to cancel your reservation and dissolve the agreement.

Deposit

The deposit is € 150.00. The deposit serves to guarantee damage and/or costs - in the broadest sense of the word - that we may suffer in the event of non-compliance with the obligations of the tenant as a good tenant and those who accompany the tenant.

The deposit must be paid together with the payment of the rent. In the event that the deposit is not paid, we are entitled to deny the tenant access to the holiday home. If you fail to pay the deposit, we are also entitled to dissolve the agreement with immediate effect.

The deposit or any remainder thereof will be refunded from us to the tenant after settlement of claims (damage to inventory/holiday home and/or other costs) within 14 days after departure. Any (further) claims for compensation will not be nullified by this refund.

Reception key and supervision

The tenant will receive the code of a key safe in which the house key is stored on the day of arrival by e-mail or text message and after payment of the full invoice amount. This code may not be transferred. The renter is never entitled to keep or duplicate the key for any reason whatsoever. Should the tenant do so anyway, the tenant will owe a fine of € 500, without prejudice to the actual costs. The key of the holiday home is made available to the tenant by us on loan. The key remains our property. In case of loss, theft or any other way of losing the key, the renter owes an amount of € 100.

There is a 'ring bell' at the front door of the house. This ring bell detects movement and makes an image and sound recording of the view from the front door. This recording will be kept and can be used as evidence in the event of a dispute.

All costs that arise because you do not deliver the house on time will be recovered from you. Goods found after your departure will be kept for you for a reasonable period of time, but we will not take any responsibility for this. Sending can be done at your expense.

If the tenant and/or other users have locked themselves out of the holiday home , € 25.00 will be charged. This is deducted from the refund of the deposit. As a check, we ask the tenant to identify himself before handing over the copy key.

Cancellation

Cancellation by the tenant must always be made in writing (by post or by e-mail). The following conditions apply to this:

  • Partial payments will not be returned in case of cancellation.
  • If canceled up to 42 days before the day of arrival, 25% of the rent is due.
  • If canceled up to 28 days before the day of arrival, 50% of the rent is due.
  • In case of cancellation from seven days up to the day of arrival, 100% of the rent is due.
  • If you have not arrived within 24 hours after the agreed date without further notice, this will be considered a cancellation and 100% of the rent will be due.
  • In case of cancellation on our part, any monies already paid will be refunded.

Stay in the holiday home

On the day of arrival, you can in principle use the holiday home from 15:00. On the day of departure, you must leave the holiday home by 10:00 am.

The holiday home is non-smoking. Smoking is allowed outside on the terrace.

No open fire may be used outside.

Bringing pets is only allowed if this is included in the rental agreement. .

The use of gas, water and electricity is included, but we ask you to use it sparingly.

Subletting or subletting is expressly prohibited.

The stay of more people in a holiday home than agreed on the reservation, or the maximum of 6 people applicable to the home, is expressly not permitted without our permission, unless otherwise agreed in writing. This can lead to the premature termination of the rental agreement on our part, without refund of rent.

Moving cupboards and beds, as well as sound or television equipment or taking any part of the indoor inventory outside with you - except of course crockery, glasses and cutlery for your meal outside - is expressly not allowed.

The tenant must ensure that the night's rest is respected between 11 p.m. and 7 a.m. This means, among other things, no loud music/noises. The tenant shall ensure that no nuisance is caused to the natural environment or to local residents. In the event of a violation, all persons will be removed from the holiday home without prior warning and without refund of rent.

Liability / Complaints / Damage

During the relevant rental period in the rented holiday home, the tenant and other users are fully liable for all damage caused to the house, the inventory and all items belonging to the rented object, unless the tenant and other users can demonstrate that the damage to cannot be attributed to them. We therefore recommend that you inspect the holiday home and its inventory for defects and shortcomings upon arrival. If you notice damage or defects, please report this to us immediately.

We accept no liability for theft, loss or damage of or to goods or persons, of any nature whatsoever, during or as a result of the stay in the holiday home. We accept no liability for construction activities on the access roads and main roads, etc. in the vicinity of the rented holiday home. We accept no liability in the event of the failure or inactivation of technical equipment, utilities, or the non-functioning or partial non-functioning of the internet.

The costs of normal maintenance and repair of defects are for our account. If defects occur, the tenant must inform us immediately and follow our instructions as much as possible. Any costs incurred by the tenant in this connection will be paid by us to the tenant against submission of itemized invoices.

It is not allowed to charge your electric vehicle with electricity from the rented accommodation. If discovered, a fine will be imposed.

If you still want to submit a complaint, this must be submitted to us in writing and with reasons within 14 days after leaving the holiday home.

Departure and final cleaning

The tenant must ensure waste separation as indicated on the waste containers. The tenant is liable, without judicial intervention, for all fines, costs, damage that the landlord suffers when the instructions regarding waste separation are not complied with. The holiday home must be left in the following manner:

Leaving the house spotless

Everything washed clean, dried and placed back in the cupboards

Duvet covers and linen folded at the ground floor stairs

Leave the dishwasher and refrigerator clean and empty

Do not leave food in the cupboards

Please put the cushions of the garden furniture inside

The garbage cans emptied

Report any breakage and/or damage to the lessor.

Applicable law

Only Dutch law applies to all these terms and conditions and to provisions from the rental agreement/house rules, as well as any disputes arising from this.
